1. Introduction

This website and online store (the "Site") are operated by Trade Secrets, 101 Jevlan Drive, Vaughan, Ontario, L4L 8C2, Canada. Throughout the Site, "we", "us" and "our" refer to Trade Secrets. By visiting the Site, creating an account or placing an order, you agree to these Terms of Service, our Refund Policy, our Shipping Policy and our Privacy Policy. If you do not agree, please do not use the Site.

The short version: be honest, be kind, use the Site only for its intended purpose, and know that we can fix errors, refuse suspicious orders and update these terms. Nothing here limits the rights you have under consumer protection laws.

2. Eligibility and accounts

  • You must be of the age of majority in your province or territory to place an order.
  • Information you give us, including when you create an account, must be accurate and kept up to date.
  • You are responsible for keeping your account details secure and for activity on your account.

3. Copyright

The content of the Site, including text, photographs, graphics, logos, designs, video and software, belongs to Trade Secrets or to our brand partners and is protected by copyright and other laws. You may view and print it for your personal, non-commercial use. You may not copy, reproduce, publish, modify, sell or otherwise use it without our written permission.

4. Trademarks

Trade Secrets and our logos are trademarks of Trade Secrets. Brand names, product names and logos shown on the Site belong to their owners. Showing them on the Site does not give you any right to use them.

5. Product information, prices and availability

  • We are partnered with the major manufacturers so that you receive authentic, up-to-date products.
  • Product claims, ingredients and other information come from the manufacturer and are not warranted by us. Always read the label and follow the directions on the product. If you have allergies, sensitive skin or a medical condition, check the ingredients or speak to a professional before using a product.
  • Prices are shown in Canadian dollars and apply to orders shipped within Canada. We try to keep prices and descriptions accurate. If a product is listed at the wrong price or with another error, we may correct it, cancel the order and refund you.
  • We may limit quantities and may refuse or cancel any order, for example if a product is no longer available.

6. Color information

We try to show product colors as accurately as we can, but the colors you see depend on your screen and may not match the product exactly.

7. Orders, payment and taxes

  • When you place an order, you confirm that you are the authorized owner of the payment method used.
  • You are responsible for any taxes or duties applicable to your order, as determined by the jurisdiction of the shipping address.
  • By placing an order, you agree to the shipment of the goods listed on your invoice.
  • We currently ship within Canada only. See our Shipping Policy for rates, free shipping and delivery times.
  • Our Site is hosted and our payments are processed by Shopify and its payment providers.

8. Returns, refunds and exchanges

Returns, refunds and exchanges are governed by our Refund Policy, including its rules for final sale items, appliances, gift cards and free gifts.

9. Promotions, discounts and free gifts

  • Promotions, discounts, duo savings and free gifts are offered while supplies last and may be changed or ended at any time.
  • Unless a promotion says otherwise, discounts are applied automatically at checkout and may not be combined beyond what the cart allows.
  • A free gift is limited to one unit per qualifying order. Additional units of the same product are charged at their regular price.
  • If you return your entire order without the free gift, its value may be deducted from your refund, as set out in our Refund Policy.

10. Gift cards

Gift cards bought on the Site are valid for online purchases only and do not expire. They are not refundable and cannot be exchanged for cash. Physical gift cards sold in our stores can be redeemed for online store credit as described in our Refund Policy.

11. Loyalty rewards

If you take part in our rewards program, points are earned and redeemed under the program rules shown on our Rewards page. Points have no cash value, cannot be transferred, and may be adjusted or cancelled if an order is returned or if we find misuse of the program. We may change or end the program.

12. Your content

You are responsible for everything you submit to the Site, including product reviews, photos, questions and comments ("Content"). Content must be truthful, lawful and respectful, and must not infringe anyone's rights, contain spam or promote other businesses. Content you post is not confidential. When you submit Content, you give us a free, non-exclusive right to display, reproduce and use it on the Site and in our marketing. We may review, edit, hide or remove any Content that breaks these terms or is unrelated to our products, but we are not required to.

13. Reviews

Reviews should describe your own experience with a product you bought or tried, and you must tell us if you received the product free or in exchange for something. Reviews express the views of the person writing them, not ours.

14. Social media content

We may ask your permission to share photos, videos or captions you shared on your own social channels. If you agree, you give us the right to publish that content on our Site, social channels and marketing, with credit to you where reasonable. You can withdraw your permission by contacting us, and we will stop new uses of that content.

15. Third-party content and sites

The Site may show content from third parties or link to other websites for your convenience. We do not control them, and we are not responsible for their content, accuracy, products or privacy practices. A link does not mean we endorse the site.

16. Fraud prevention

We check orders for signs of fraud and for suspicious or unlawful activity. We may refuse, hold or cancel an order, cancel an account, or decline to deliver to an address if we suspect fraud, resale abuse, or a breach of these terms or our policies. We may contact you to confirm an order.

17. Our rights

We may, at any time, change, suspend or stop any part of the Site, and block access for anyone who misuses it or breaks these terms. We may keep and share your information when the law requires it, to enforce these terms, or to protect our rights, our customers or others.

18. Privacy and communications

How we collect, use and share your information is described in our Privacy Policy. By placing an order you agree that we may send you order status and service emails. We send marketing messages only as described in our Privacy Policy, and you can unsubscribe at any time using the link in each message.

19. Disclaimer of warranties and liability

The Site is provided "as is" and "as available". To the extent permitted by law, we do not promise that it will always be available, error-free or free of harmful components, and we are not liable for indirect, incidental or consequential damages when you use the Site or buy the products, whether properly or not. Our total liability for any claim relating to an order is limited, to the extent permitted by law, to the amount you paid for that order. Nothing in these terms limits any rights you have under applicable consumer protection laws, including rights that apply to defective products or products that are not as described.

20. Indemnification

To the extent permitted by law, you agree to cover reasonable costs and losses we suffer because you misused the Site, broke these terms or the law, or infringed someone else's rights through your Content.

21. Waiver and severability

If we do not enforce a part of these terms right away, we have not given up the right to do so later. If any part of these terms is found to be invalid or unenforceable, it is limited or removed only as far as needed, and the rest stays in effect.

22. Language

These terms are provided in English and French. If the two versions differ, the English version applies, to the extent permitted by law.

23. Changes to these terms

We may update these Terms of Service from time to time. Changes take effect when they are posted on this page, and the "Last updated" date shows the latest version. Your continued use of the Site after a change means you accept it.

24. Disputes and governing law

If you have a problem, please contact our customer service first through our Contact Us form or by phone at 905-264-2799. Most issues can be solved that way. These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and you agree to the courts of Ontario for any dispute that we cannot solve together, to the extent permitted by law.
